Registers

Under the Local Government Act 1999 and the Development Regulations 2008, the District Council of Elliston is required to keep a number of registers. In most cases, the register is available for inspection by the public at the District Council of Elliston, Beach Terrace, Elliston. Some registers are also available online.

Building Upgrade Agreements

Under Section 13 of Schedule 1B of the Local Government Act 1999, Council must keep a register of building upgrade agreements.

District Council of Elliston does not have any building upgrade agreements.

By-Laws

Under Section 252 of the Local Government Act 1999, Council must keep a register of all by-laws made or adopted by the Council.

Campaign Donation Returns

Under Section 81 of the Local Government (Elections) Act 1999, Council must prepare a campaign donations return register which incorporates the campign donations return for each candidate for election.

Council Employee Gifts and Benefits Register

Under Section 1(3) of  Schedule 2A of the Local Government (General) Regulations 2013, the Council must maintain a register of gifts and benefits received by employees of Council and must ensure that the details of each gift and benefit provided are included.

Elected Members' Gifts and Benefits Register

Under Section 79(a) of the Local Government Act 1999, the Council must ensure that a record is kept in accordance with the regulations, the following details about a member of Council as recorded within the Register of allowances and Benefits

the annual allowance payable to the member

details of any expenses reimbursed by the council under Section 77(1)(b); and

details of other benefits paid or payable to, or provided for the benefit of the member by the Council.

Elected Members' Register of Interest

Under Section 70(a1) of the Local Government Act 1999, the Council must publish on the website, in accordance with the regulations, the following details about a Council Member as recorded in the Register of Interest:

  • the member's income sources (within the meaning of Schedule 3 to the Local Government Act) of employer;
  • the name of any political party, any body or association formed for political purposes or any trade or professional organisation (within the meaning of Schedule 3) of which the member is a member;
  • any gifts received by the member that are required to be included in the information entered in the Register in relation to the member

Elected Members' Register of Interests

Elected Members' Declaration of Interest

Section 74 of the Local Government Act 1999 requires that Elected Members declare any interest and provide full and accurate details of the relevant interest to the Council prior to consideration of that item on the Agenda. Each Member of a Council has a duty to vote at all meetings unless excepted by legislation.

The major exception being where a Member has a conflict of interest.

Public Roads

Under Section 231 of the Local Government Act 1999, Council is required to keep a register of public roads in the area.

Department Heads and Interests

Under Section 116 of the Local Government Act 1999, Council is required to maintain a Register of Interests for the Chief Executive Officer and any other officer declared by Council.

Employees' Gifts and Benefits Register

Salaries and AllowancesUnder Section 105 of the Local Government Act 1999, the Council must ensure that a record (the Register of Salaries) is kept which records:

  • the title of each position held by an employee of COuncil;
  • where the employee is paid according to salary scales set in an award or industry agreement;

- the classifications of those employees

- the salary scales applicable to each classification (and number of employees at each level); and

- details of other allowances or benefits paid a saprt of a salary package

  • where the employee is not paid according to salary scales set in an award or industry agreement

Under Section 26(1)(a) of the Local Government Act 1999, Council must maintain a register of dogs.

Schedule of Fees and Charges

Under Section 188(6) of the Local Government Act 1999, Council must keep a list of fees and charges imposed under Section 188 on public display during ordinary office hours at the principal office of the Council.

Under Section 15 of the Local Government (Elections) Act 1999, Council must maintain a Voters' Roll for the area.
